Terms of sale.

These terms govern any order placed on sweness.com. By placing an order, you acknowledge having read and accepted them without reserve.

Article 01

Purpose and acceptance

These Terms of Sale govern the contractual relationship between Sweness — published by Sweness SAS — hereinafter "the Seller", and any adult natural person making a purchase on sweness.com, hereinafter "the Customer". Any order placed implies the Customer's unreserved acceptance of these Terms. The Seller reserves the right to modify the Terms at any time; the applicable conditions are those in force at the time of the order.

Article 02

Products

Products available for sale are those shown on sweness.com, subject to availability. Sweness reserves the right to modify the product range at any time. Each product is presented with a description, composition, photographs and price. Photographs are not contractually binding and may slightly differ from the delivered product (slight variations in shade or material).

Article 03

Prices

Prices are shown in euros (€), all taxes included (TTC), excluding shipping. Shipping fees are specified at the time of order, before cart validation. Sweness reserves the right to modify its prices at any time; products are billed at the rate in force at the time the order is recorded.

Article 04

Order

To place an order, the Customer selects the desired products, validates the cart, fills in their details and proceeds to payment. The order is definitively recorded once payment has been accepted. A confirmation email is then sent to the Customer at the address provided. Sweness reserves the right to cancel or refuse any order from a Customer with whom there is an unresolved payment dispute on a previous order.

Article 05

Payment

Payment is made online by credit card (Visa, Mastercard, American Express) via the secure Shopify Payments platform. No bank data is stored on Sweness servers. The debit is made at the time of order validation. If the payment is refused by the bank, the order is automatically cancelled.

Article 06

Delivery

Orders are shipped within 3 to 5 business days after payment confirmation. Delivery times vary by destination: · Mainland France: 2 to 4 business days · European Union: 4 to 7 business days · Rest of the world: 7 to 14 business days Shipping is free in France for orders over €150. Below this amount, or for international destinations, fees are calculated at checkout. In case of late delivery, the Customer may contact Contact@sweness.com for any complaint. The Seller is not liable for delays caused by the carrier or force majeure.

Article 07

Right of withdrawal

Under articles L. 221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the product to exercise their right of withdrawal, without having to justify their decision. To exercise this right, the Customer must notify their decision to Contact@sweness.com before the deadline. The product must be returned in its original condition, unworn, unwashed, with its labels and original packaging. Return shipping is the Customer's responsibility. The refund is processed within 14 days of receipt of the returned product, using the same payment method as the original order.

Article 08

Legal warranty

Under articles L. 217-3 et seq. of the French Consumer Code, Sweness is required to deliver products that conform to the contract and is liable for any conformity defects existing at the time of delivery. The Customer has 2 years from delivery to act. The legal warranty against hidden defects (articles 1641 to 1648 of the French Civil Code) also applies. For any claim, write to Contact@sweness.com with photos and a description of the defect.

Article 09

Liability

Sweness shall not be held liable for any damage resulting from misuse of the products, failure to follow care instructions (wash at 30°C, no tumble dry), or force majeure.

Article 10

Personal data

Data collected as part of the order is necessary for its processing. The Customer has the rights provided by GDPR (access, rectification, deletion, opposition, portability). For details, see the Privacy Policy.

Article 11

Disputes and applicable law

These Terms are governed by French law. In case of dispute, the Customer may recourse free of charge to consumer mediation. Failing amicable resolution, French courts shall have exclusive jurisdiction.
